What is a Title Search?

You’ve decided to purchase a home and hope to take possession as soon as possible. The terms have been agreed upon and all the financial arrangements have been made. But there is one important detail remaining. Before the transaction can close, a title search must be done. “Title” is essentially a bundle of rights in real property. A title search is a search of public records to determine what these rights are and who owns them. A title search searches for current and past owners, mortgages, judgments, liens, taxes and other information that may affect title in a property. Our attorneys perform comprehensive title examinations to determine whether the person who is selling the property really has the right to sell it, and whether the buyer is getting all the rights to the property the buyer is paying for.   However, because a title report may not reflect all easements, we also advise commercial and residential clients to order a survey, conduct an in-person inspection of the property prior to purchasing, and ask the seller to disclose any prescriptive easements in writing.

What is Title Insurance and Why is It Important?

Almost all real estate closings include obtaining title insurance. Institutional lenders typically require title insurance and every form contract contains provisions requiring and discussing title insurance terms and conditions. Title insurance ensures the marketability of the title on a property and ensures the buyer is receiving “good title.”   Title insurance is crucial, particularly as title issues may only arise or be discovered after closing—undiscovered liens or judgments on the property or on the prior owners, forged deeds, falsified records, improper legal descriptions, and other encumbrances. The title insurance company will, at its own expense, defend the title and pay losses within the coverage of the policy should any occur.
